Glorify 365 Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of the Glorify 365 web application and companion mobile app (collectively, the "Service"), operated by Mercs LLC ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, do not use the Service.

2. The Service

Glorify 365 provides summaries of books from an explicitly Christian perspective. We reserve the right to modify, add, or remove content at any time without notice. Content on the Service is intended for personal enrichment and does not constitute theological, spiritual, or professional advice.

3. Account Registration

You must be at least 18 years of age to create an account. By registering, you represent that the information you provide is accurate and that you will keep it current.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not share your account with others or create more than one account per person.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payment

Access to the Service requires a paid monthly subscription. Your subscription begins on the date of purchase and renews automatically each month until cancelled.

Payments are processed by a third-party payment processor. By subscribing, you authorize recurring charges to your payment method on a monthly basis. Current pricing is displayed at checkout. We reserve the right to change subscription pricing with reasonable advance notice; continued use after a price change takes effect constitutes acceptance of the new price.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service through the end of that period and will not be charged for the following month.

Refunds: We will issue a refund of your most recent monthly payment upon request. Charges from prior billing periods are non-refundable. Refund requests must be submitted to support@glorify365.org.

5. User Content

You may create notes and bookmarks within the Service. This content is private to your account and is not visible to other users.

If you choose to share any content externally — for example, by posting to social media — you do so at your own discretion and responsibility. We do not control, monitor, or take responsibility for how you share content on third-party platforms.

6. Intellectual Property

All content, summaries, design, trademarks, and branding within the Service are owned by or licensed to Mercs LLC and are protected by applicable intellectual property laws.

You are granted a limited, personal, non-exclusive, non-transferable license to access and use the Service for your own personal, non-commercial purposes. This license does not include the right to reproduce, distribute, modify, publicly display, or create derivative works from any content within the Service.

You may not scrape, crawl, reverse engineer, or otherwise access the Service by automated means, or use any content from the Service for commercial purposes without our express written consent.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any content will be accurate, complete, or suitable for your particular purpose.

Content on the Service reflects a Christian perspective and is intended for general enrichment. It does not represent any specific denomination and should not be relied upon as theological, spiritual, or professional advice.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Mercs LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

Our total liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the total amount you paid to us in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Mercs LLC and its officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service in violation of these Terms.

11. Dispute Resolution

These Terms are governed by the laws of the State of Montana, without regard to its conflict of law principles.

Informal Resolution: Before initiating any formal dispute, you agree to contact us at support@glorify365.org and give us 30 days to attempt to resolve the matter informally.

Binding Arbitration: If informal resolution fails, any dispute arising out of or related to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place remotely. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Small Claims: Either party may bring an eligible claim in small claims court in lieu of arbitration.

Class Action Waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration against Mercs LLC.

12. Termination

You may cancel your subscription and close your account at any time through your account settings. Upon termination, your license to use the Service ends. Your data will be handled in accordance with our Privacy Policy.

We may suspend or terminate your access to the Service at any time, with or without notice, if we determine that you have violated these Terms or that continued access poses a risk to the Service or other users. In cases of material violation, termination may be immediate and without refund.

13. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes your acceptance of the revised Terms.

14. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mercs LLC regarding the Service and supersede any prior agreements.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
